Collection of Information

By using Indigon’s online sites, products, and services, users agree that we may collect personally identifiable information (as defined below). Indigon will not share personally identifiable information with other parties except as described in this policy. We may also collect aggregate information and individual information. "Aggregate information" is information that describes the habits, usage patterns, and demographics of users as a group but does not describe or reveal the identity of any particular user. "Individual information" is information about a user or user’s machine that is presented in a form distinguishable from information relating to other users but not in a form that personally identifies any user or enables the recipient to communicate directly with any user. Personally Identifiable Information

"Personally identifiable information" is information that can be used to uniquely identify a user, such as name, address or credit card number, email address. You may be asked to provide personally identifiable information in connection with the use of Indigon’s products, services and online sites. While Indigon collects personally identifiable information on a voluntary basis, for certain products and services Indigon’s collection of personally identifiable information may be a requirement for access to the product or service or to process a user’s order.

Use of Personally Identifiable Information

Personally identifiable information is used internally by Indigon to develop, deliver and improve our products,content and services. In addition, we may allow third parties performing services under contract with Indigon, such as order or payment processors or merchandise warehouse and fulfillment services, to access and use personally identifiable information, but only to the extent necessary to provide those services.

Indigon will not share personally identifying information with third parties for marketing purposes. We may use personally identifying information provided by users to send information about Indigon, including news about product updates, contests, events, and other promotional materials, but only if the users agree to receive such communications.

In some situations, personally identifiable information that users input in connection with their use of our products may be available to other users of Indigon products. For example, during the creation of a Indigon account, we collect a user's email address and username, and at the user's option, first and last name. Some of this information maybe searchable and available to other users within Indigon network. Indigon has no obligation to keep private personally identifiable information that a user makes available to other users via Indigon Network or other Indigon software, such as in multiplayer chat or other public functions.

External websites and companies with links to and from Indigon's online sites and products may collect personally identifiable information about users. Third party publishers may also collect personally identifiable information as a requirement of accessing their games or content. Indigon's privacy policy does not extend to these external websites and companies or third party publishers. Please refer directly to these companies and websites regarding their privacy policies.

We may release personally identifiable information to comply with court orders or laws that require us to disclose such information. In the event of a reorganization, sale or merger we may transfer personally identifiable information to the relevant third party.

Non-Personal Information

We also collect other information that does not identify you that you provide as part of registration and through your use of the Services (“Non-Personal Information”).

When using our online customer support we may ask for more non-personal information to help us better support our customers. We may need to collect the following items: operating system, browser versions, hardware specifics, host names, IP addresses, username, various software versions installed, and various hardware driver versions installed. This information will enable us to understand your personal environment and better help solve your issues when using our products or services.

Children Under The Age of 13

Indigon will not knowingly collect personally identifiable information from any person age 12 and under. We encourage parents to instruct their children to never give out personal information when online. Parents who are concerned about the transfer of personal information from their children may contact us.

The Services are intended for general audiences and do not knowingly collect any personal information from children. If a parent or guardian becomes aware that his or her child under the age of 13 has provided us with Personal Information without their consent, he or she should contact us at sgff@indigoninc.com and we will remove the information.

Cookies and Other Information on a User's Machine

Indigon’s products, services and sites may employ cookies and other technologies such as web beacons and pixel tags. Like many websites, we use “cookies” to collect information. A cookie is a small data file that is transferred to your computer’s hard disk to customize a person's use of a product or online site, keep records of a user's access to an online site or product, or store information needed by the user on a regular basis. Use of cookies is typically associated with websites. We utilize session ID cookies to enable certain features of the Services, to better understand how you interact with the Services and to monitor aggregate usage by Indigon Users and web traffic routing on the Services. Session cookies are deleted from your computer when you log off from the Services and Site and then close your browser, depending on your current browser settings. Indigon gives users the option to receive promotional email communications from us. Users may opt out of these communications. Instructions for discontinuing receipt of promotional email communications from us will be provided in email communications to users.

Phishing

Identity theft and the practice currently known as “phishing” are of great concern to Indigon. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your Account information, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication.

Information Sharing and Disclosure

Non-Personal Information

We may aggregate and/or anonymize information collected by the Services or via other means so that the information does not identify you. Our use and disclosure of aggregated, anonymized, and other Non-Personal Information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation for any purpose.

Service Providers

Compliance with Laws and Law Enforcement

Indigon cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Indigon or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.

Business Transfers

Indigon may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

Changing or Deleting Your Information

All Indigon Account holders may review, update, correct or delete the Personal Information provided during registration by contacting us at sgff@indigoninc.com. If you completely delete all such information, then your Account may become deactivated. If you would like us to delete your Account in our system, please contact us at sgff@indigoninc.com with a request that we delete your Personal Information from our database. We will use commercially reasonable efforts to honor your request. We may retain an archived copy of your records as required by law or for legitimate business purposes.

Storage and Security of Personally Identifiable Information

Indigon is very concerned with safeguarding your information. We employ various in house developed, open source, and when appropriate commercially reasonable physical, technological, and administrative security measures and attempt to ensure they are applicable under the circumstances. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use the above acceptable means to protect your personal information, we cannot guarantee its absolute security.

Indigon stores any Personally Identifiable Information on our hosted servers that are operated and located in the US. We work with 3rd party developers in the UK that may have access to the US based servers and Personally Identifiable Information.

We operate the Services in the United States, and the United Kingdom, depending on your country of residence, the submission of Personal Information via the Services may involve some transfer of personal information the United States, or the United Kingdom. You should be aware that privacy laws in the United States, and the United Kingdom may not provide protections equivalent to those of your country of residence. We have taken steps to ensure that appropriate levels of protection necessary to maintain the security and quality of your Personal Information are in place and that any transferred data is processed only in accordance with this Privacy Policy. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
